Biography

Called to the bar in 1990

Herschel Fogelman graduated Osgoode Hall Law School in 1988 and was called to the bar in 1990. Since his call to the bar he has practiced exclusively in the area of family law. His approach is to make every effort to find a negotiated resolution to family disputes. Herschel recognizes however that not all family disputes can be negotiated and, when litigation is necessary, he is a persuasive advocate. Herschel has argued cases at all levels of court, including the Ontario Court of Appeal. Herschel is currently listed in the The Best Lawyers International directory and the Canadian Legal Lexpert® directory which recognizes lawyers who are leaders in their practice areas according to the Lexpert annual peer surveys. As an adjunct to his practice, Herschel is a certfied mediatior, bringing a calm, balanced and reasoned approach to problem solving. He has successfully mediated a large number of family disputes, ranging in degree of difficulty and conflict. He has, when the need arises, arbitrated many Family Law disputes efficiently and fairly, and is regularly called on by his peers to act in an arbitrative capacity regarding sensitive family law issues. In recognition of these skills, Herschel has been appointed as a Dispute Resolution Officer for the Superior Court of Justice in Toronto. Herschel was an instructor for many years with the Family Law section of the Bar Admission course. He was part of the team of lawyers chosen by the Law Society of Upper Canada to draft the standardized Separation Agreement for use by all Ontario Family law lawyers. For a number of years, he served as a panel lawyer for the Ministry of the Attorney General (Offices of the Children’s Lawyer) as a legal representative for children in a variety of family disputes. He is a former Trustee for the Toronto Lawyers Association, a member of the Toronto Bench and Bar Committee. He is a frequent presenter and chair of for a wide variety of law programs, ranging in topics from Family Law, to advocacy and mediation skills. Articles Herschel has written have appeared in a wide variety of publications including, "Money & Family law". Herschel is an avid cyclist and cycling commuter and was an elected member of the City of Toronto Cycling Committee. His other hobbies include hockey, canoeing and camping. Herschel is married with two children.
